The rules of the road for our farm'ily — buyers, sellers, members & friends. Give 'em a read, y'all.

All items, animals, livestock, plants, equipment, and goods purchased or sold through Calling Kritter Auction — at any live in-person sale, online auction, or consignment — are sold and purchased “AS IS, WHERE IS, WITH ALL FAULTS,” without warranties of any kind. Calling Kritter Auction, Ali's Farm of Groveland, and Ali Farm of Groveland, LLC are not responsible for anything. You bid, buy, sell, and attend at your own risk.

Who We Are

Howdy, and welcome to the farm'ily! These Terms of Service (the “Terms”) govern your use of the website at callingkritter.com and every service we offer — in person and online.

In these Terms, “Calling Kritter Auction,” “CKA,” “we,” “us,” and “our” mean Calling Kritter Auction, operated at Ali's Farm of Groveland by Ali Farm of Groveland, LLC, a Florida limited liability company. “You” means any visitor, bidder, buyer, seller, consignor, member, or user of our site or services.

Agreeing to These Terms

By visiting our website, registering for a bidder number, bidding, buying, selling, consigning, joining a membership, entering a giveaway, or stepping onto our property for an auction, you agree to be bound by these Terms. If you don't agree, please don't use our site or services.

You confirm that you are at least 18 years old (or the age of majority where you live) and able to enter a binding agreement. These Terms are the entire agreement between you and us about our website and services, and they supersede any earlier understandings.

Our Services

Calling Kritter Auction is a community-minded livestock and farm auction serving Groveland, Florida and beyond. Depending on the day, our services include:

🐄 Live In-Person Auctions — on-site bidding for livestock, plants, equipment, tack, and farm goods at our property in Groveland.
💻 Online “Click Wars” Auctions — online bidding across categories like Livestock, Tack & Outdoor Gear, Tools, Arts & Crafts, and Odds & Ends.
🌾 Auction Consignment & Selling — bring your kritters and goods to market through our consignment process.
💎 Memberships — our Diamond, Gold, Silver, and Lammy's Wild Kritter VIP memberships, with perks and benefits for the farm'ily.
🎉 Giveaways — recurring community giveaways such as our Monthly Calf Giveaway.
🤝 Member Supporters — our community recognition program celebrating locals who support locals.

We may add, change, pause, or retire any service at any time. Pricing, availability, schedules, and fees may change or update without notice.

“As Is, Where Is” & No Responsibility

This is the most important part, so we'll say it plain.

All items, animals, livestock, plants, equipment, tack, and goods purchased or sold through Calling Kritter Auction — whether at a live in-person sale, an online auction, or by consignment — are sold and bought “AS IS, WHERE IS, WITH ALL FAULTS,” with no warranties or guarantees of any kind, whether express or implied. That includes (but is not limited to) any implied warranty of merchantability, fitness for a particular purpose, health, soundness, temperament, breed, age, gender, productivity, condition, authenticity, or title.

Calling Kritter Auction, Ali's Farm of Groveland, and Ali Farm of Groveland, LLC are NOT responsible for anything relating to any item or animal bought or sold, including its condition, health, behavior, description, fitness, performance, defects, illness, injury, death, or any loss or damage that results. We make no representation or warranty about any lot, and we do not verify, guarantee, or stand behind any description, photo, or claim — whether provided by us, a seller, a consignor, or anyone else.

You are responsible for inspecting any item or animal before you bid or buy. Bring your own knowledge, your own vet, and your own judgment. Once the gavel falls or the online lot closes, the sale is final and the item or animal is yours, where it sits, exactly as it is.

Descriptions, ages, breeds, weights, and details are provided by sellers and consignors and are not guaranteed by us. Any claim about an item or animal is the sole responsibility of the seller or consignor who provided it — not Calling Kritter Auction.

Registration & Bidder Numbers

To bid, buy, or sell, all you need is a bidder number — it lets you both buy and sell at our auctions.

Membership is optional. You do not need to join a membership to participate as a buyer or seller at our live in-person auctions. A membership is entirely optional and simply unlocks extra perks — like early consignment drop-off, cash back, and fee waivers.
Get your bidder number. Register for your personal bidder number to start buying and selling.
Valid government ID required. A copy of a valid government-issued photo ID is required and kept on file with your bidder record for anyone buying or selling with us.
Department of Agriculture records. As required by the Department of Agriculture, we keep records of every buyer and seller, and of the housing and premises of each animal sold at Calling Kritter Auction, for animal-traceability purposes. By participating, you agree to provide the information we need to meet these requirements.

You're responsible for everything that happens under your bidder number and account, so keep your details accurate and your login to yourself. You agree to provide true, current information. We may refuse, suspend, or cancel any registration, bidder number, or account at our discretion.

Buyer Terms

All sales are final. Every winning bid is a binding commitment to purchase. There are no refunds, returns, exchanges, or cancellations once a lot is won, unless we say otherwise in writing.
As Is, Where Is. Everything you buy is sold “AS IS, WHERE IS, WITH ALL FAULTS,” with no warranties of any kind — see Section 04 for the full details.
Payment. Payment is due in full at checkout per the payment methods we accept. Title and risk of loss pass to you once the lot is awarded, and you're responsible for the item or animal from that moment on.
Pickup & removal. You're responsible for promptly and safely removing, loading, transporting, and caring for anything you buy, including providing proper transport and humane handling for live animals. We are not responsible for items or animals left behind.
Buyer's premium & fees. Any buyer's premium, taxes, or service fees that apply will be shown at checkout.

Live In-Person Auctions

Our live auctions take place at 4105 Soto Road, Groveland, FL 34736. When you attend:

The auctioneer's decision is final on all matters, including bid disputes, bid increments, the order of sale, withdrawing a lot, and re-opening or re-selling a lot.
A bid is a binding offer. When the gavel falls, the highest acknowledged bidder is the buyer and owns the lot “AS IS, WHERE IS, WITH ALL FAULTS.”
You must settle your account at checkout before removing purchases from the property.
We may add, withdraw, combine, or split lots at any time, and we do not guarantee that any particular item or animal will be offered.

Online “Click Wars” Auctions

Online lots are also sold “AS IS, WHERE IS, WITH ALL FAULTS,” with no warranties of any kind. Photos and descriptions are a guide only and are not guaranteed.
Placing a bid is a binding commitment to purchase if you win. The highest bid when the lot closes wins, subject to any reserve.
Winning bidders must pay in full per the listing, then arrange pickup or any available delivery within the stated window. Unclaimed items may be forfeited.
We are not responsible for internet outages, device or browser issues, bidding errors, timing glitches, or any technical problem that affects a bid. We may cancel, re-list, or correct any listing affected by error.

Sellers & Consignment

Want to sell your kritters and goods with us? Here's how it works. Full, current details live on our Seller's Barn page.

Get set up. Sellers just need a bidder number and a valid government ID on file before consigning — membership is optional and not required to sell.
Drop-off times. Saturday 10:00 AM–4:15 PM for all sellers. Early Friday-evening drop-off (6:00–9:00 PM) is an exclusive perk for Diamond VIP & Gold members.
Consignment fees. We keep a commission on each sale based on the category of item or animal. The current commission schedule, no-sale fees, and any service fees are as published on the Seller's Barn page and may change without notice.
No-sale fees. A small no-sale fee may apply to items or animals that don't sell, as published on the Seller's Barn page. Certain members may be exempt — see your membership perks.
Membership savings. Cash back on sales commissions and waivers of certain fees are benefits available to qualifying members, as described on the Memberships and Seller's Barn pages.
You own what you bring. You represent that you have clear, lawful title and the right to sell everything you consign, and that it is free of liens. You are solely responsible for the accuracy of every description, age, breed, and detail you provide.
Payouts. Seller payouts are processed within 10 to 14 days following the auction sale date, less applicable commission, no-sale fees, tagging, and any other fees. We may hold or offset a payout to cover chargebacks, disputes, or amounts you owe us.
As Is, Where Is. Everything you consign is offered to buyers “AS IS, WHERE IS, WITH ALL FAULTS.” We do not warranty your items or animals, and we are not responsible for them.

Livestock & Animal Health

We take the health of every kritter seriously — for the safety of all animals and our farm'ily. By bringing or buying animals, you agree to the following:

USDA Scrapie tags. Required by law — all goats and sheep of any age must have an official USDA Scrapie tag before entering the auction. On-site tagging is available for a fee during posted hours.
Cattle identification. Cattle over 18 months must have an official USDA EID electronic ear tag. Calves and cattle under 18 months do not require a USDA tag.
Health & rejection. We reserve the right to turn away any animal showing signs of illness or distress — including nasal discharge, abnormal droppings, eye discharge or pink eye, lethargy, or any other visible sign of poor health.
Humane handling. Sellers and buyers must handle, contain, feed, water, and transport animals humanely and lawfully, and provide proper cages, crates, and transport.
You assume all animal risk. Live animals are sold “AS IS, WHERE IS, WITH ALL FAULTS.” We do not guarantee any animal's health, soundness, temperament, breeding status, pregnancy, productivity, age, or breed, and we are not responsible for any illness, injury, death, disease transmission, or loss involving any animal before, during, or after a sale.

Memberships

Our memberships — Diamond, Gold, Silver, and Lammy's Wild Kritter VIP — unlock perks for the farm'ily. By joining, you agree that:

Recurring billing. Paid memberships renew automatically at the then-current rate and interval until cancelled. By subscribing, you authorize us (and our payment processor) to charge your payment method on each renewal.
Perks may change. Membership benefits, cash-back rates, fee waivers, drop-off windows, and giveaway entries are described on the Memberships page and may be adjusted, added, or removed at any time.
Cancellation. You may cancel a membership at any time through your account or by contacting us. To avoid being charged for the next billing cycle, you must cancel before your renewal date; cancellations received on or after the renewal date take effect at the end of the cycle then in progress. Cancellation stops future renewals, and — unless required by law — membership fees already paid are non-refundable, with benefits continuing through the close of your paid period.
Eligibility. Perks apply only while a membership is active and in good standing. We may suspend or cancel a membership for non-payment or violation of these Terms.

Giveaways

Giveaways (such as the Monthly Calf Giveaway) are run as a thank-you to our community. Eligibility, entry methods, bonus entries for members, drawing dates, and prizes are described where each giveaway is posted.
Winners may be required to claim a prize within a stated window and to arrange their own pickup, transport, and care. Prizes have no cash value and may not be substituted except at our discretion.
Giveaways are void where prohibited and are subject to all applicable laws. We may modify, suspend, or cancel a giveaway at any time. We are not responsible for any prize, including the condition or health of any animal awarded, which is provided “AS IS, WHERE IS, WITH ALL FAULTS.”

Payments, Sales Tax & Returns

Payment methods. We accept the payment options shown at checkout and may change our payment procedures at any time without prior notice.
Sales tax. We charge applicable sales tax based on the rate and rules that apply to your purchase. Valid tax-exempt or agricultural buyers must provide proper documentation in advance.
Pricing & errors. Information on this site may contain inaccuracies or typographical errors. Pricing and availability may change without notice, and we may correct errors, cancel orders, or refuse service in our discretion.
No returns. Because everything is sold “AS IS, WHERE IS, WITH ALL FAULTS,” all sales are final and there are no returns or refunds unless we agree in writing or the law requires it.
Unpaid balances. Any unpaid balance will be invoiced to the mailing address or email address on file in your bidder account, and payment is due upon receipt. You are responsible for keeping your contact information current, and you remain liable for the full amount owed, along with any costs of collection permitted by law.

Wild Kritters Coins & In-Game Purchases

Our members area includes free browser games — Wild Kritters Farm'ily and Wild Kritters Match Up. These games use a virtual, in-game currency called Wild Kritters Coins (“Coins”), provided purely for entertainment.

Coins are for play only. Coins are a virtual in-game item with no monetary or cash value. They cannot be redeemed for cash, and cannot be sold, traded, transferred, gifted between accounts, or exchanged for any real-world goods or services. Coins work only inside the games on your Calling Kritter account.
Free to earn, optional to buy. Coins can be earned for free through normal gameplay, or purchased through our secure checkout. Buying Coins is entirely optional.
Parental consent. Coin purchases may be made only by a member who is 18 or older, or by a minor with the permission and supervision of a parent or guardian. The account holder is solely responsible for all purchases and activity on their account, including purchases made by children with access to that account. Please keep your login credentials secure.
Delivery & refunds. Coins are a digital product delivered to your game account immediately upon successful payment. For that reason, all Coin purchases are final and non-refundable once the Coins have been delivered. If you believe a purchase was made in error, you were charged incorrectly, or the Coins did not appear in your account, contact us promptly at bibi.z@callingkritter.com or (352) 255-5300, and we'll work with you in good faith to make it right.
Account & availability. Coins are tied to the Calling Kritter account on which they were earned or purchased and have no value outside that account. Coins are not redeemable upon the cancellation, suspension, or termination of your account or membership, and any unused Coins may be forfeited. We may modify Coin pricing, pack sizes, or game features, or discontinue the games or the Coin system, at any time.
Not responsible. Calling Kritter Auction and Ali's Farm of Groveland are not responsible for any loss of Coins resulting from account issues, technical problems, or unauthorized account access.

Conduct & Right to Refuse Service

We're building something good here, so we ask everyone to act with honesty and respect. You agree not to interfere with auctions, bid without intent to pay, disrupt the farm or the farm'ily, or break any law on our property or our site.

We reserve the right to refuse service, deny entry, remove any person, terminate accounts, cancel orders, withdraw lots, and ban bidders — at our discretion, including when we believe conduct violates the law or is harmful to the interests of Calling Kritter Auction or our farm'ily.

Assumption of Risk on the Farm

A working farm and live auction is an active place with animals, equipment, vehicles, uneven ground, and the unexpected. By coming onto our property, you do so at your own risk.

You voluntarily assume all risks of personal injury, illness, death, or property damage arising from your visit — including risks from animals (bites, kicks, escapes, zoonotic disease), equipment, slips and falls, weather, and the conduct of others. You are responsible for your own safety and the safety of any children or guests you bring. To the fullest extent allowed by law, you release Calling Kritter Auction, Ali's Farm of Groveland, and Ali Farm of Groveland, LLC from any liability for any such injury, loss, or damage.

Disclaimer of Warranties & Limitation of Liability

Everything we offer — our website, our auctions, our services, and every item and animal — is provided “AS IS” and “AS AVAILABLE,” WITH ALL FAULTS and without warranty of any kind. To the fullest extent permitted by law, Calling Kritter Auction, Ali's Farm of Groveland, and Ali Farm of Groveland, LLC disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We make no warranty that the website or any content is accurate, complete, current, secure, or error-free. The website may contain technical inaccuracies or typographical errors, and content may change without notice.

To the fullest extent permitted by law, Calling Kritter Auction, Ali's Farm of Groveland, and Ali Farm of Groveland, LLC are not responsible or liable for anything, and will not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages of any kind — including loss of profits, livestock, property, data, or goodwill, or injury, illness, or death of any person or animal — arising from or related to your use of our site, services, auctions, memberships, giveaways, or any item or animal bought or sold, even if we have been advised of the possibility of such damages.

Where liability cannot be fully disclaimed by law, our total liability to you for any claim is limited to the amount you actually paid to us for the specific item, animal, or service giving rise to the claim. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you; in that case, our liability is limited to the maximum extent allowed by law.

Indemnification

You agree to defend, indemnify, and hold harmless Calling Kritter Auction, Ali's Farm of Groveland, Ali Farm of Groveland, LLC, and their owners, members, staff, and volunteers from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising from your use of our site or services, your bidding, buying, selling, or consigning, your items or animals, your breach of these Terms, or your violation of any law or the rights of another.

Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. You agree that any dispute will be brought exclusively in the state or federal courts located in or serving Lake County, Florida, and you consent to the jurisdiction of those courts. Both parties expressly waive the right to a trial by jury.

If any part of these Terms is found unenforceable, that part will be adjusted to reflect our intent as closely as the law allows, and the rest stays in full force and effect. Our failure to enforce any provision is not a waiver of it.

Changes to These Terms

We may update these Terms from time to time. When we do, we'll post the revised version here and update the “Last Updated” date. Notices posted on our website are considered delivered. Your continued use of our site or services after a change means you accept the updated Terms, so check back now and then, y'all.
